These Terms of Service ("Terms") govern your access to and use of the Akiliwo Connect website, applications, and services (the "Service"), operated by Akiliwo Connect LLC ("Akiliwo," "we," "us," or "our"). By creating an account, placing an order, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are and what we do
Akiliwo Connect is a shopping, delivery, and shipping-logistics company. We shop for and deliver goods that customers order from us; arrange the shipping of mail, parcels, and goods; and coordinate the logistics of shipping customer-owned vehicles.
When you place an order, you are purchasing goods and/or a service from Akiliwo. Akiliwo is the seller and merchant of record for the goods and services we provide. Any stores, markets, suppliers, shoppers, or carriers we use are our suppliers or independent contractors.
We are not a bank, money transmitter, money services business, or remittance provider. We do not transfer money or value from one person to another, do not hold customer funds for the purpose of transfer, and do not send cash on anyone's behalf. Every payment you make to Akiliwo is consideration for goods and/or services that Akiliwo provides.
2. Definitions
- "Customer" / "you" — the person who places and pays for an Order.
- "Recipient" — the person who receives a delivery.
- "Shopper" — an independent contractor engaged by Akiliwo to purchase and/or deliver goods.
- "Goods" — items we purchase and deliver for you, or that you ship through us.
- "Order" — a confirmed, paid request for goods and/or services.
3. Our services
a. Shop & Send to Nigeria. For customers (often in the USA) ordering goods — groceries, foodstuff, cosmetics, gifts, fashion, electronics, household items — to be purchased and delivered to a Recipient in Nigeria.
b. Shop within Nigeria. For customers in Nigeria ordering goods to be delivered to their own door, priced and paid in Naira.
c. Ship from the USA. Shipping of mail, documents, parcels, gifts, and non-perishable goods from the USA to Nigeria, priced by weight, size, and service.
d. Car Shipping & Logistics. Logistics coordination for shipping a customer-owned vehicle to Nigeria. See Section 9.
4. Orders, pricing, and payment
- Package prices are displayed before checkout. Custom orders are quoted as a service fee plus the confirmed cost of the goods, which you approve before we purchase anything.
- Payment is required up front through our third-party payment providers.
- USA orders are generally charged in USD; within-Nigeria orders in NGN. Prices may include a reasonable buffer for exchange-rate movement and supplier price changes.
- We may decline or cancel any Order, including for suspected fraud, prohibited items, or inability to fulfill.
5. Substitutions and approvals
If an item is unavailable or its price differs materially from the quote, we will seek your approval for a substitution or a revised price where practical. If we cannot reach you and a reasonable substitution is not possible, we may omit the item and adjust your total.
6. Delivery and proof of delivery
- Delivery time estimates are estimates, not guarantees.
- On each delivery, our Shopper captures and uploads a photo and a short video at handover as proof of delivery, attached to your Order.
- You are responsible for an accurate delivery address and a reachable Recipient. Re-delivery due to incorrect information you provided may incur additional fees.
7. Your responsibilities
You agree to: provide accurate information; ensure the goods you order or ship are lawful to buy, sell, export, import, and possess in both countries; not use the Service for any unlawful, fraudulent, or prohibited purpose; and ensure a Recipient is reasonably available to receive delivery.
8. Prohibited and restricted items
You may not order, send, or ship through the Service:
- cash, cheques, money orders, or any other monetary instrument;
- gift cards, vouchers, airtime, cryptocurrency, or stored-value items;
- prescription medicines, controlled substances, or drug paraphernalia;
- alcohol, tobacco, vaping, or related products;
- weapons, ammunition, explosives, or hazardous/dangerous materials;
- counterfeit, replica, or pirated goods, or anything infringing intellectual-property rights;
- live animals, human remains, or perishable goods for cross-border shipping (except fresh goods purchased and delivered locally within the destination country as part of our shopping service);
- any item classified as non-mailable or non-shippable by a carrier or postal authority, or that is illegal or restricted for export from the origin country or import into the destination country.
We may refuse, cancel, hold, or return any Order that includes a prohibited item, and may report unlawful activity to the authorities. You are responsible for any loss, fine, or seizure resulting from prohibited or misdescribed items.
9. Car Shipping & Logistics — special terms
For vehicle shipping, Akiliwo acts solely as a logistics coordinator.
- You buy and own the vehicle. You source and purchase your own vehicle, in your own name. Akiliwo does not buy, sell, finance, broker the sale of, advertise, or take title to any vehicle.
- You pay third parties directly. You pay the shipping line/carrier for ocean freight, and the Nigeria Customs Service for all import duties, taxes, and levies, directly. These payments do not pass through Akiliwo.
- Our fee. You pay Akiliwo only a coordination fee for documentation assistance, booking, customs liaison, and doorstep delivery.
- Eligibility and verification. Before booking, your vehicle must have a genuine title in your name and meet the destination country's vehicle-age and import requirements. We perform title-history and theft checks and may decline any vehicle that fails (salvage, washed, rebuilt, stolen-flagged, over-age, or VIN-mismatched).
- No guarantee of customs outcome. Customs valuation, duties, inspection, and release are determined by government authorities, not by Akiliwo. We are not responsible for duties, penalties, delays, storage charges, seizures, or losses arising from your vehicle, your documentation, or customs decisions, including any arising from inaccurate information you provided.
- Compliance. You are responsible for compliance with all applicable US export laws and destination-country import laws.
10. Cancellations
You may cancel before we begin shopping (for goods) or before we begin verification/booking (for vehicle shipping) for a refund as described in our Refund Policy. Once shopping or vehicle work has begun, cancellation rights are limited.
11. Refunds
Refunds are governed by our Refund & Returns Policy, incorporated into these Terms by reference.
12. Disclaimers and limitation of liability
- The Service is provided "as is" and "as available," without warranties except those that cannot be excluded by law.
- To the maximum extent permitted by law, Akiliwo's total liability for any Order is limited to the amount you paid Akiliwo for that Order, excluding third-party costs such as freight and customs duties.
- Akiliwo is not liable for indirect, incidental, special, or consequential damages, or for delays or losses caused by suppliers, carriers, customs authorities, or events beyond our reasonable control.
13. Disputes and chargebacks
If something goes wrong, please contact us first — most issues are resolved quickly. Filing a payment dispute or chargeback without first contacting us may delay resolution. You agree to cooperate in good faith before escalating.
14. Privacy
Your use of the Service is also governed by our Privacy Policy.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted with a revised "Last updated" date. Continued use after changes take effect constitutes acceptance.
16. Governing law and contact
These Terms are governed by the laws of Colorado, United States, without regard to conflict-of-law rules. For services delivered in Nigeria, local laws may also apply.
